Terms of Service

These Terms of Service ("Terms") govern your access to and use of Podcast.pick (the "Service"), operated by Podcast.pick ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Podcast.pick is an AI-powered subscription service delivered via Telegram that provides personalized podcast episode and YouTube video recommendations. The Service is accessible through the Telegram messaging platform.

2. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Accounts and Registration

Access to the Service requires a Telegram account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

• The Pro Plan is offered at $3.99 USD per month, billed monthly.
• Your subscription will automatically renew monthly unless you cancel before the renewal date.
• All payments are processed by Paddle.com (our Merchant of Record). By subscribing, you also agree to Paddle's terms of service.
• Prices may change upon 30 days' written notice to you.

5. Cancellation and Refunds

• You may cancel your subscription at any time through customer.paddle.com.
• Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date.
• Refunds are handled by Paddle as Merchant of Record in accordance with their Buyer Terms. You have the right to request a refund within 14 days of purchase. Refunds are granted at Paddle's discretion.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service beyond normal use of the Telegram bot
• Share your account credentials with others

7. Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

Content recommended by the Service (podcasts, YouTube videos) belongs to their respective creators. We do not claim ownership of third-party content.

8. Third-Party Services

The Service relies on third-party platforms and APIs including Telegram, YouTube, and various podcast directories. We are not responsible for the availability, accuracy, or content of third-party services. Your use of those services is subject to their respective terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOMMENDATIONS WILL MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

13. Service Discontinuation

We reserve the right to discontinue the Service at any time, at our sole discretion, with or without prior notice. In the event of a permanent shutdown:

• All active subscriptions will be cancelled effective at the end of the current billing period. You will not be charged for any subsequent period.
• You will retain access to Pro features until the end of your paid billing period.
• The Telegram bot and all related services will cease to operate upon shutdown.
• We will make reasonable efforts to notify users in advance via the Telegram bot where possible.

We shall not be liable for any damages or losses resulting from the discontinuation of the Service, beyond any prorated refund of prepaid subscription fees for the unused portion of the current billing period.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Israel.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by sending a message via the Telegram bot or by updating the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
